Driving whilst your license is suspended, disqualified, cancelled or refused is illegal under section 54 of the Road Transport Act 2013 (NSW).
The offence is committed by any person who drives a motor vehicle whilst their license is suspended.
The maximum penalty for a first time offender committing this offence is $3300 and a 6 month driving disqualification. For a second or greater time offender, the maximum penalty is $5500 and a 12 month driving qualification. In worst case scenarios, first time offenders may also be imprisoned for up to 6 months and for second time offenders within a 5 year period may face a maximum imprisonment period is 12 months.
Driving whilst suspended is a serious offence and regardless of whether you are a first time offender or not, a criminal conviction may be recorded if you are found guilty or plead guilty.
