Most people who are required to appear at court for a driving offence have never come before a court previously and are unfamiliar with the court system and protocols. The legislation covering driving offences is extremely complicated and an offender will rely on the court to act in his or her best interests. By engaging a solicitor a person can rely on the solicitor to provide accurate and clear advice as to which options they should follow.

When a person attends court, the solicitor will present submissions to the court and the person is only required to stand up initially and once acknowledged by the court will then sit down until the court is ready to pass sentence. When the court is passing sentence the person must stand and face the Magistrate or Judge. Usually a solicitor will advise a client where to sit and indicate to the client when to stand and sit down.

When you are represented by a solicitor you are not required to speak directly to the court, and only in rare situations will a court speak to you when you are represented by a solicitor at court.
